Welcome to Tedious. By creating a Tedious account or using any Tedious services, you agree to be bound by these Terms of Service (“Terms”).
As used in these Terms, “Tedious,” “we,” “us,” or “our” means Tedious, Inc. (or the applicable Tedious contracting entity).
“You” means the individual or business using the Services, including owner-operators, small crews, or organizations (“Pros”).
If you do not agree to these Terms, you may not access or use the Services.
1. The Tedious Platform
Tedious provides a business operating platform for home service professionals, including tools for:
customer communication (SMS, chat, email)
AI-assisted messaging and automation (“Ted”)
quoting, booking, scheduling, and job management
payments, deposits, and receipts
customer business pages and checkout experiences
reporting, analytics, and operational tools
All features and services offered by Tedious are referred to collectively as the “Services.”
Any new features added to the Services are also subject to these Terms.
2. Account Terms
2.1 Eligibility
To use Tedious, you must:
be at least 18 years old (or the age of majority in your jurisdiction)
use the Services for business purposes, not personal or household use
provide accurate, complete, and current account information
We may reject or terminate accounts at our discretion.
2.2 Account Responsibility
You are responsible for:
all activity on your account
maintaining account security
ensuring your login credentials are kept confidential
Tedious is not liable for losses resulting from unauthorized access due to your failure to secure your account.
2.3 Primary Contact
You must maintain a valid email address (“Primary Email Address”) capable of receiving communications. Tedious may use this email for notices related to billing, security, legal matters, or account changes.
3. Account Ownership & Team Access
3.1 Account Owner
The individual or business that creates the account is the Account Owner and is responsible for compliance with these Terms.
If you create an account on behalf of a business, you represent that you have authority to bind that business.
3.2 Team Members
Depending on your plan, you may grant access to employees, subcontractors, or team members. You are responsible for their actions and compliance with these Terms.
4. Payments, Billing, and Fees
4.1 Subscription Fees
You agree to pay all applicable subscription fees, transaction fees, and usage-based fees associated with your plan (“Fees”). Fees are billed in advance and are non-refundable unless required by law.
4.2 Payment Processing
Tedious uses third-party payment processors. By using payment features, you agree to the terms of those providers.
Tedious is not the merchant of record for transactions between you and your Customers.
4.3 Taxes
You are solely responsible for determining, collecting, reporting, and remitting any applicable taxes related to your business and transactions.
5. Your Responsibilities to Customers
Tedious is not a marketplace. Any contract for services is strictly between you and your Customer.
You are responsible for:
services you offer and perform
pricing, refunds, cancellations, and disputes
legal compliance in your jurisdiction
customer disclosures, policies, and communications
Tedious does not guarantee bookings, payments, or customer behavior.
6. Acceptable Use
You agree not to:
use the Services for unlawful, deceptive, or abusive purposes
send spam or unauthorized marketing messages
impersonate others or misrepresent your business
interfere with platform security or performance
attempt to reverse engineer or bypass safeguards
We may suspend or terminate accounts that violate these rules.
7. AI-Powered Features (“Ted”)
Tedious provides AI-assisted features to help automate communication, quoting, and follow-ups.
You acknowledge that:
AI responses are generated based on provided data and instructions
you remain responsible for reviewing and approving outputs where applicable
AI features do not replace professional judgment or legal obligations
Tedious does not guarantee the accuracy, completeness, or suitability of AI-generated outputs.
8. Your Content & Data
8.1 Ownership
You retain ownership of all content you submit, including messages, job details, photos, pricing, and branding (“Your Materials”).
8.2 License to Tedious
You grant Tedious a worldwide, non-exclusive, royalty-free license to host, use, process, display, and modify Your Materials solely to operate and improve the Services.
8.3 Customer Data
Customer data you collect through Tedious belongs to you. Tedious processes this data on your behalf in accordance with our Privacy Policy and Data Processing Addendum (if applicable).
9. Intellectual Property
Tedious owns all intellectual property related to the Services, including software, branding, logos, and AI systems.
You may not use Tedious trademarks or branding without written permission.
10. Third-Party Services
Tedious may integrate with or link to third-party services (e.g., SMS providers, payment processors, mapping tools).
Use of third-party services is at your own risk and subject to their terms. Tedious is not responsible for third-party products or services.
11. Confidentiality
Each party agrees to protect the other’s confidential information and use it only to perform obligations under these Terms, except where disclosure is legally required.
12. Privacy & Data Protection
Tedious processes personal information in accordance with our Privacy Policy.
By using the Services, you agree to our collection and use of data as described there.
13. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TEDIOUS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
14. Limitation of Liability
To the fullest extent permitted by law, Tedious will not be liable for:
lost profits, revenue, data, or goodwill
indirect, incidental, or consequential damages
customer disputes or payment issues
Tedious’s total liability will not exceed the amount you paid to Tedious in the prior 12 months.
15. Indemnification
You agree to indemnify and hold Tedious harmless from claims arising out of:
your use of the Services
your business operations
customer disputes
violation of laws or third-party rights
16. Termination
You may cancel your account at any time. Tedious may suspend or terminate access for violations, non-payment, or legal risk.
Upon termination:
access to Services ends
outstanding fees remain payable
no refunds are provided
Certain sections survive termination, including payment obligations, liability limits, and confidentiality.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or the platform. Continued use of the Services constitutes acceptance of the updated Terms.
18. Governing Law
These Terms are governed by the laws of the State of [Insert State], United States, without regard to conflict-of-laws principles.
